Conditions of Entry

5Towns is open to Bike SA members. Neither Leukaemia Foundation, Mihell & Lycos or Kimon Lycos WILL NOT BE LIABLE FOR PERSONAL INJURY OR PROPERTY DAMAGE. The person/s attending 5Towns and other associated events (Events) hereby acknowledges and agrees as follows: They have read and understood the Conditions of Entry (Conditions) and agrees to be bound by the Conditions; and intends the Conditions to have full contractual effect. Where relevant, the person/s and any third party who purchases a Stage/s on behalf of the person/s ("the third party") each warrant that the third party had the person/s full authority to act as the person/s agent for the purposes of buying the ticket and accepting the Conditions.

CYCLING ON THE OPEN ROAD IS DANGEROUS – In exchange for being able to attend or participate in the event, (and as a condition of the purchase or issue of a Stage/s entry): You agree to release Leukaemia Foundation, Mihell & Lycos or Kimon Lycos, along with other promoters, sponsor organisations, land owners and, organisers of the event, their respective servants, officials, representatives and agents (collectively, the "Associated Entities") from all liability for your death, personal injury, psychological trauma, loss or damage (including property damage) ("harm") howsoever arising from your participation in or attendance at the event, except to the extent prohibited by law; you agree that Leukaemia Foundation, Mihell & Lycos or Kimon Lycos and the Associated Entities do not make any warranty, implied or express, that the event services will be provided with due care and skill or that any materials provided in connection with the services will be fit for the purpose for which they are supplied; and you agree to attend or participate in the event at your own risk. You acknowledge that the risks associated with attending or participating in the event include the risk that you may suffer harm as a result of: motor vehicles (or parts of them) colliding with cyclists, persons or property; acts of violence and other harmful acts (whether intentional or inadvertent) committed by persons attending or participating in the event. You acknowledge that cycling is dangerous and that accidents causing harm can and do happen and may happen to you. You accept the conditions of, and acknowledge the risks arising from, attending or participating in the event and being provided with the event services by Leukaemia Foundation, Mihell & Lycos or Kimon Lycos and the Associated Entities.
